    Patents Term Extension

    Important commercial pharmaceutical products (as well as medical devices) may have the term of patents covering them extended by up to five additional years, beyond the normal patent term of 20 years. The conditions under which such a patent is eligible for patent term extension are complex and at times raise complicated questions. 

    The patent term extension (PTE) legal framework in Israel is complex and the PTE provisions have been amended several times in the past decade. The issuance of an Israeli PTE order is influenced by a drug’s marketing approval and the issuance of corresponding PTE and/or SPCs outside Israel (the US and 5 European countries). The duration of the Israeli PTE order is calculated based on the corresponding PTE and SPCs and the expiry of the order is influenced by the status of these foreign term extensions.

    What is Patent Term Extension?

    Patents are in force 20 years from the date of the first filing of the patent application. However, the duration of patents related to pharmaceutical products or medical devices can be extended provided that various conditions, which are prescribed in the Israeli Patent Act, are met. 

     

    The Israeli Patent Term Extension (PTE) system is provided as a means of compensating a patent owner for patent term that was lost due to the need to obtain approval of a product by the regulatory authorities in Israel. 

    How is Patent Term Extension different in Israel?

    The manner in which the duration / expiry date of PTEs in Israel is calculated is rather unique in light of its dependence on data pertaining to 6 other countries (the “Recognized Countries”). The 6 Recognized Countries, on the basis of which the duration / expiry date of Israeli PTEs is calculated, are the U.S., Italy, U.K., Germany, Spain and France.

    How many years of additional protection can I hope for through a successful PTE process?

    The term of effect of an extension order shall not exceed five years beyond the normal patent term of twenty years from patent filing.
