    Designs

Designs are powerful means for driving business growth. Like trademarks, designs form a core part of the characteristics that make it possible to assert the identity of a brand. The appearance, such as the shape or pattern of your company’s products or packaging can be protected through design registration. Almost anything with a new appearance can be registered and we advise on the eligibility of your design.

At Luzzatto and Luzzatto, we help clients define their strategies for protecting, defending, optimizing and monitoring their designs. We provide comprehensive design services: from a design search and preliminary check of the material to be filed, to filing applications for the registration of designs in Israel, and in different countries around the world. After filing, we handle the prosecution process, which includes responding to the examiners in the different countries, up to the point of registration of the design.

Luzzatto and Luzzatto is very active in the registration of designs abroad, both directly and via the Hague agreement. Our firm is also involved in landmark litigation that has preserved the rights of important commercial products. Since we are always fully prepared for any changes in the IP world, we were the first firm in Israel to file a design application via the Hague system on the day it came into effect.

Due to the new law in Israel, which came into effect in 2018, and the lack of extensive case law, our expertise in this field is of great value to clients. Our design team can provide professional support every step of the way, making sure that our clients’ designs are protected and creating value for their business.

    FAQs

    What is a design?

A design is a form of protection for an industrial product. It covers the product’s appearance or salient elements of the product, distinguishing it from similar products. It is a relatively inexpensive form of protection but is limited since any significant aesthetic changes in a product will result in one that is not covered by the previous design.

    Why should designs be protected?

Designs are a very efficient way to avoid competition when your product has an aesthetic component that appeals to the consumer and helps the consumer distinguish it from competing products. Some designs become so popular that they dictate the consumer’s behavior and result in significant business advantages.

    How can designs be protected?

Designs can be protected by filing an application to register the specific design, which consists of images showing the particular elements believed to be novel and significant.
